Declaration of independence

Akilli Enterprise, a business established in Surat, Gujarat, India (the “Company”), hereby unequivocally declares that Zariknyaa (the “Brand”) is a wholly independent Indian brand, conceived, founded and owned by the Company since 2019.

The Brand has no corporate, commercial, contractual, licensing, franchise, partnership or promotional relationship of any kind with any other brand, company, designer or group of companies. No such relationship has existed at any time, and none shall be inferred from any similarity of name, sound or appearance.

Origin of the name

The name “Zariknyaa” is an original name adopted by the Company. It is derived from the word zari (also jari), the fine thread of gold or silver that has adorned the textiles of the Indian subcontinent for centuries, and reflects the Brand's dedication to India's weaving heritage.

Any phonetic or visual resemblance between the name “Zariknyaa” and the name of any other brand is purely coincidental and shall not be construed as indicating any common origin, connection or endorsement.

Social media comments & comparisons

Users of social media sometimes share comments, memes or comparisons that link the name Zariknyaa with other brands. While the Company appreciates the goodwill of its community, it states categorically that:

1. such remarks are made independently by third parties and are not official statements of the Company;
2. no comment, meme, comparison or post shall be treated as evidence of any relationship between Zariknyaa and any other brand; and
3. customers should rely only on the official information published by the Company on zariknyaa.com when making a purchase decision.

Third-party trademarks

ZARA and all other brand names are trademarks of their respective owners. Any reference to another brand on this page is made solely for the purpose of identification and clarification, in good faith, and does not imply any association with, or endorsement by, the owner of that trademark. The Company respects the intellectual property of every brand and expects the same respect for its own.

Brand ownership & product imagery

The name Zariknyaa, its logo and its brand identity are the exclusive property of Akilli Enterprise. All rights in them are expressly reserved and are protected under the laws of India, including the Trade Marks Act, 1999, together with the remedy against passing off. No person shall use, imitate, adapt or commercially exploit the Zariknyaa name or logo, in whole or in part, without the prior written consent of the Company.

Product photographs, videos and other visual material displayed on zariknyaa.com are sourced from our weavers, manufacturers and supply partners and are used solely to represent the products offered for sale. The Company does not claim ownership of such material, and all rights in it remain with their respective owners.

Impersonation & unauthorised sellers

Any website, social media account, marketplace listing, seller, reseller or individual that falsely claims to be Zariknyaa, to be associated with Zariknyaa, or to sell Zariknyaa products under the authority of the Company, does so without authorisation. In respect of any such party:

1. purchases made through any channel not operated or expressly authorised by Akilli Enterprise are not covered by the Company's policies, guarantees or customer support;
2. the Company shall bear no responsibility for any loss, damage or fraud arising from dealings with such parties; and
3. genuine Zariknyaa products and official information are available at zariknyaa.com.

Official channels of communication

The Company communicates with customers only through the following two channels. Any communication received from any other source shall not be attributed to the Company.

Reservation of rights

This Declaration is issued without prejudice to all rights and remedies available to Akilli Enterprise in law and in equity. The Company expressly reserves the right to initiate appropriate civil and/or criminal proceedings, including claims for injunction, damages and the delivery-up of infringing material, against any person who:

1. uses, copies or imitates the Zariknyaa name, logo or brand identity without authorisation;
2. misrepresents any association, partnership or endorsement involving the Brand; or
3. otherwise infringes, dilutes or damages the rights, reputation or goodwill of the Company.

Any failure or delay by the Company in enforcing any right shall not constitute a waiver of that right.

Governing law & jurisdiction

This Declaration shall be governed by and construed in accordance with the laws of the Republic of India. The courts at Surat, Gujarat shall have exclusive jurisdiction over all matters arising out of or in connection with it.
